Challenging SOI discrimination

Source of Income (SOI) discrimination is sometimes a smoke screen for illegal discrimination

SOI discrimination is not illegal in Ohio (except City of Wickliffe) but it is increasingly added to state l;aws and local ordinances around the country.
Owners of LIHTC properties may not bar tenants with HCVs.
Some Federally assisted properties may not bar HCVs.

Examples
 Landlord denies a homeseeker because she/he has a third party payer including Housing Choice Voucher (HCV)



  Some Remedies
1. If tenant is a member of a protected class, contact a fair housing agency to conduct tests to see if owner's policy is a smokescreen for illegal discrimination.
2. Check to see if property is funded with Low Income Housing Tax Credits or HOME dollars.
3. Report owner to local PHA or other referral agency and encourage these agencies to stop doing business with this owner.

 Landlord advertises "no Metro" or "no Section 8" in print or on the Web.

4.  Contact publisher and ask that the paper or website bar terms that discriminate.
 Landlord refuses to accept a rent payment made by someone other than the tenant.  Third party payments may be necessary because a tenant has a disability. In such cases, ask for a reasonable accommodation

 Landlord requires tenant be employed in order to be eligible to rent

 Requiring income from employment may have a disparate impact on a protected class. Contact a Fair Housing Agency.
