Tenant had a lease, lease expired...what now?

What do we need to know
  • What did the original lease say about renewal?
  • Did the tenant offer rent after the lease expired? (witnesses, documents?)
  • Did the landlord accept rent after the lease expired?

 The basics
If the lease says "renew for a like term" then the lease automatically renews for a year; if the lease says "renews on a month to month basis" then the lease is in force on a month-to-month; if the lease says nothing about renewal, but the tenant continues to say there...then it is a defacto renewal on a month to month basis.
